Getting COVID 19 Disability Benefits During the Pandemic

Covid 19 disability benefits

By Gerald M. Welt, Esq.

Because it is very difficult to navigate the Social Security Disability system it is very important that those filing for Social Security Disability benefits use an attorney.  Contacting a law firm that has experience in the Social Security Disability system gives those who are ill, injured or disabled, who anticipate being out of work for more than 12 months or who are out of work for more than 12 months, a better opportunity to win their claims.

Survivors of the recent COVID-19 outbreak are now calling with questions about their eligibility for Social Security Disability benefits.  People with Heart Disease, Parkinson’s Disease, Lupus, Arthritis, Cancer and other life changing illness, injuries or disabilities may also be eligible for Social Security Disability benefits, when they are or anticipate being out of work for more than 12 months.

Our process for preparation includes an initial interview, which during the COVID-19 pandemic is done by telephone. We will guide you through the initial application process or let you know how to file the initial application yourself.  When you have been denied benefits you should call Welt Law immediately as these are time sensitive actions. There is no charge for this consultation.

Once a contract with the attorney and client is signed you are entered into the process to prepare your case for hearing.  We contact all doctors and medical providers and review thousands of pieces of documentation to help prove that our clients are ill, injured or disabled and deserving of benefits. We ask each client, over the 18 months to 2 years that we are preparing their case for hearing, to contact our office when they receive additional medical evidence and to call our offices monthly to provide us with updates. There is no charge for our time in preparing a case for hearing.

We meet with each client 1 to 2 weeks before the hearing for pre-hearing preparation so that they are aware of the process, review the evidence gathered and explain what to expect at the hearing.  On the date of the scheduled hearing we arrive on time and are prepared for the hearing. We are called for the hearing when the judge is ready for us and sometimes that means waiting while they finish other hearings. During the pandemic all hearings are conducted by telephone.  Still no fees for our work. Our fees are calculated from past due benefits and sent to us directly from the Social Security Administration when we win your case.

If an appeal has been remanded, meaning it was sent back to the judge for further consideration because the original decision contained a significant error of law or was not supported by the substantial weight of the evidence, then we have the opportunity to retry the case, if we are the attorney of record at that time.

Welt Law is ready to take your call at 702.382.2030 as soon as you realize you will be out of work for at least 12 months due to illness, injury or disability.  There is no charge for consultation.  Attorney fees are paid out of past due benefits, so there is no initial out of pocket cost to you. We are not paid our fees until we win your case. The sooner you make the call the sooner your case begins the process of getting you the benefits that you deserve.
