Nevada’s Workers’ Compensation

Nevada Workers’ Compensation is a state-mandated insurance program which covers medical expenses, lost wages, and rehabilitation costs. In order to receive compensation for a work injury, there are very specific guidelines that must be followed. Under Nevada Workers' Compensation Law, there are certain notifications that must be made, forms must be filled out, and deadlines must be met. If these deadlines are not met an injured or ill employee may forfeit benefits they would otherwise deserve.

Nevada's Workers' Compensation is designed to provide benefits to employees who suffer job-related injuries or illnesses and get them back to work as soon as possible. In exchange for Workers' Compensation benefits, employees forfeit their right to sue their employer for workplace injuries. A compensation claim is not the same thing as a lawsuit. When injured on the job or suffering from an Occupational Illness, an employee must fill out a C-1 form to report their injury. This Incident Report is a "NOTICE OF INJURY OR OCCUPATIONAL DISEASE" form pursuant to NRS 616C.015. An injured employee has 7 days to fill out a form C-1 and return it to their employer. Those suffering from an occupational disease will have 7 days to return the form to the employer from the moment of a medical diagnosis by a physician. All deadlines must be met in order to be awarded benefits.

Nevada’s Workers’ Compensation system is meant to support injured employees or employees suffering from occupational illness or disease or injury. The unwieldly claims process can be complex and frustrating. Insurance companies may deny claims, delay payments, or offer less compensation than deserved.

If your Workers’ Compensation claim was denied or if your employer or your employer’s insurance company is disputing a part of your claim, under the Nevada laws you have the right to appeal this decision within 70 days. An informal hearing with an appointed hearing officer will be held to either approve or deny this claim. If you do not agree with the decision from the hearing officer, you will have 30 days to file an appeal with the Appeals Officer.
