Disability Backpay in Las Vegas
See What Determines Your Social Security Disability Backpay
Disability backpay covers the months between a claimant’s first payable month and the approval decision. The amount can depend on when the disability began, when the claimant applied, the monthly benefit amount, and the rules for the applicable program.
Welt Law helps Las Vegas claimants understand these factors while pursuing Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI). Whether you’re waiting for a decision or reviewing an award notice, we can examine the claim record and explain how the relevant dates may affect your backpay.

How SSDI Backpay Is Calculated
The Social Security Administration determines when your qualifying disability began, known as the established onset date. The agency then applies the program’s waiting-period and retroactivity rules to identify your first payable month.
The total generally depends on your monthly SSDI benefit and the number of payable months through the award period. Because other details in the claim record can affect the calculation, the dates in the award notice should be compared with those recognized by the agency.
An SSDI calculation generally follows these steps:
- Identify the disability onset date accepted by the Social Security Administration.
- Apply the five-month waiting period when required.
- Determine the first payable month under the filing and retroactivity rules.
- Count the months included in the applicable award period.
- Apply the claimant’s monthly benefit amount to those months.
The Five-Month Waiting Period
SSDI benefits are generally payable beginning with the sixth full month after the established onset date. For example, if the agency finds that a qualifying disability began on the first day of a month, the next five full months generally make up the waiting period, subject to the claim’s facts.
An exception applies to qualifying amyotrophic lateral sclerosis claims approved on or after July 23, 2020. Those claims aren’t subject to this delay.
Retroactive Benefits Before Filing
SSDI can provide retroactive benefits for as many as 12 months before the application date if the claimant was disabled and met the applicable requirements during that period. The waiting-period rule still applies within this window. As a result, filing 12 months after a disability began doesn’t automatically create 12 payable months.
Why Choose Welt Law?
More Than 40 Years of Experience with Disability Claims
We practice primarily in Social Security Disability Insurance, Supplemental Security Income, and guardianship law. Gerald Welt and Tiffany Welt Doctors bring more than 40 years of professional experience to this work. Our representation focuses on the evidence and procedural record the Social Security Administration uses to decide eligibility.
We assess disability qualifications, help complete applications, and gather medical documents and supporting evidence. We also prepare clients for disability hearings and assist after a denied claim. Legal representation doesn’t control the agency’s backpay calculation or payment timing, but careful preparation can give the agency the evidence needed to evaluate the claimed disability period.
Representation Through Each Appeal Level
A denial doesn’t necessarily end a claim. Depending on the circumstances and procedural stage, we may represent clients through reconsideration, an Administrative Law Judge hearing, Appeals Council review, and a possible federal court appeal. At a hearing, the claimant can present testimony and evidence to a judge reviewing the disability claim.
The Social Security Administration determines eligibility, establishes the payable period, and calculates the award under the applicable rules. We help clients organize the record, understand agency notices, prepare for proceedings, and respond to issues affecting the claim.

Get Clear Answers About Your Disability Backpay
Request a free consultation if you have questions about backpay, need guidance on a pending application, or want to challenge a denial. We can review your claim’s status and explain the next procedural step without promising a particular approval, payment amount, or processing timeline.
We handle many cases through a contingency fee agreement, which means the fee is paid from past-due benefits if the claim succeeds. Under the Social Security Administration’s standard fee-agreement process, the fee is capped at the lesser of 25% of past-due benefits or $9,200 for applicable decisions made on or after November 30, 2024. Fees require government approval.
In most cases, the Social Security Administration withholds the approved fee and pays us directly from the award. Clients are rarely responsible for out-of-pocket expenses, and our firm states that clients aren’t charged unless we’re successful.
