When the Social Security Administration denies an initial disability application and then denies it again at reconsideration, the next step is a hearing before an Administrative Law Judge. At that hearing, the SSA typically calls a vocational expert to testify about whether the claimant can still perform past work or whether other jobs exist in significant numbers in the national economy. That testimony often affects the outcome. What a Vocational Expert Does at Your Hearing

Before the hearing, the vocational expert reviews the case exhibits and the claimant’s work history report. At the hearing, they classify each job the claimant held during the past 15 years using the Dictionary of Occupational Titles, a U.S. Department of Labor publication that assigns standardized codes to job types. That classification captures the physical demands, mental demands, and skill level of each position.

The Administrative Law Judge then poses a series of hypothetical questions, each describing a person of the claimant’s age, education, and work background with a specific set of functional limitations. The judge first asks whether that person could still perform the claimant’s past work (Step 4 of the sequential evaluation process). If the answer is no, the judge asks whether other jobs exist in significant numbers in the national economy that person could still do (Step 5). If the vocational expert identifies enough such jobs, the claim may be denied at that step.

The vocational expert doesn’t decide disability status. They testify as a neutral witness paid by the SSA for their time, and the Administrative Law Judge makes the final decision after weighing all the evidence, including medical records and the claimant’s own testimony.

How We Approach Vocational Expert Testimony

Claimants have the right, through their attorney, to cross-examine the vocational expert at the hearing. That cross-examination is where preparation matters most. Our attorneys review the vocational expert’s classifications and identify whether additional limitations, such as a need for unscheduled breaks or significant off-task time, would eliminate the jobs identified. When those follow-up hypothetical questions are posed correctly, the vocational expert’s answer can challenge the denial basis.

We also question the methodology behind job-number estimates. National labor statistics use a different classification system than the Dictionary of Occupational Titles, and the source data behind a vocational expert’s numbers isn’t always as solid as it appears.
